Apparently in some parts of Canada the accused is granted “extra-credit” for days waiting to go to trial. Pre-trial days in custody can count for multiple-days of your sentence if found guilty.
An interesting idea, it would seem to encourage the government to get their investigation done, so the defendant can have their speedy-trial.
On the other hand, if the defendant, and their council, is deliberately postponing the trial, it’s a brilliant tactic to reduce the overall time spent in jail!
“When you’re doing a criminal investigation, you have to wait two to three months for the results from the lab, that’s really hindering your investigation, your ability to interview witnesses,” he said. “Today, lots of crime is solved by forensics. If I can sit you down and say we just got the report from the lab and it’s pointing to you, that gives us a better investigation tool and the ability to figure out what went on.”
